Every person has a right to inspect the public records of the Office of Broadband Access and Expansion (OBAE), except those records falling within the exceptions listed in the Inspection of Public Records Act (“IPRA”), found at NMSA Sections 14-2-1 through 14-2-12.

IPRA Records Request Procedure
The Records Custodian shall provide records as soon as practicable, but no later than 15 days after receiving a written request. If the release is not possible within 3 business days, OBAE shall explain, in writing, when OBAE will respond to the request. A request that is emailed during normal business hours will be considered received that day. Requests that are emailed after business hours, on holidays, or on weekends, will be considered received the first business day after the email is sent. Records Request Pricing Requesters may specify in their original IPRA request that they would like physical copies of responsive records. OBAE requires advance payment for physical copies of records. Requesters will be charged as follows for physical copies of records:

If any entity or individual working with OBAE contends that information requested by OBAE is confidential, and not subject to production in response to a public records (IPRA) request, they must submit a “Request for Confidential Status/OBAE Determination.” The request form must include sufficient legal and factual information to support a request for confidentiality under New Mexico law. OBAE counsel will approve or deny a request based on the information provided.
OBAE’s confidentiality determination will be issued on the same form as the request, and returned to the individual who made the request. It is important that all requests are submitted on the form without any encryption or permissions restrictions that would prevent OBAE counsel from working within the confidentiality form. OBAE’s determination will be issued to the requester within two (2) weeks of receipt of the request.
If any entity or individual declines to request confidentiality though this process, OBAE counsel will make an independent determination regarding access to information OBAE’s possession in response to an IPRA request. How to Submit a Confidentiality Request
