​Benefit of the Bargain Round

Submission Window EXTENDED: July 7 through July 21, 2025

The New Mexico Office of Broadband Access and Expansion (OBAE) will accept applications for the Benefit of the Bargain round of the BEAD Program in compliance with the BEAD Restructuring Policy Notice. Only prequalified applicants may submit an application.

Pursuant to the Policy Notice, OBAE has made several changes to the application for the Benefit of the Bargain round. Some of these include:
  • Removal of disallowed questions to comply with the Policy Notice
  • Removal of duplicative questions to streamline the application process 
  • Eligibility of underserved locations and CAIs for funding, in addition to unserved locations
  • Addition of new technical specifications templates for projects seeking to be considered Priority Broadband
  • Addition of secondary scoring criteria questions
  • Modifications to the Low-Cost Service Option requirement to comply with the Policy Notice

As a reminder, all previously submitted applications must be rescored and evaluated against the new requirements. Accordingly, OBAE strongly encourages applicants who submitted in Round 1 of the BEAD program to modify their Round 1 application(s) to align with the new requirements. Previous applicants may also submit a new application(s) in lieu of or in addition to modifying their previous application(s).

The BEAD Restructuring Policy Notice supersedes all other guidance documents relating to New Mexico's BEAD application process. If guidance provisions of other components of New Mexico's BEAD application process are not addressed in the Policy Notice, applicants should consider them in full force and effect and are responsible for reviewing OBAE BEAD materials to ensure compliance. ​Benefit of the Bargain Round Prequalification - MANDATORY for Prospective BEAD Applicants
The BEAD Prequalification Window opens June 17 and the deadline to submit is June 30, 2025.
The New Mexico Office of Broadband Access and Expansion (OBAE) is accepting prequalification applications for the BEAD Program in compliance with the BEAD Restructuring Policy Notice issued by the National Telecommunications and Information Administration (NTIA) on June 6, 2025. This process enables prospective applicants to establish their qualifications and capabilities to plan, finance, deploy, and maintain broadband networks while driving commercial success and adhering to all legal and regulatory requirements. OBAE aims to prequalify prospective applicants in advance of accepting Benefit of the Bargain Round applications. The deadline to submit a Prequalification application is June 30, 2025 at 11:59pm MT.

Organizations that are already prequalified need not submit an additional prequalification application. Organizations who had submitted a Prequalification application for Round 2 may edit their application to align with the new program guidelines.

Webinar: BEAD Program Changes in Compliance with NTIA's BEAD Restructuring Policy Notice
June 25, 2025

On June 25, 2025, the New Mexico Office of Broadband Access and Expansion presented a webinar covering changes to the BEAD Program in compliance with NTIA's BEAD Restructuring Policy Notice. The webinar provided an overview of notable changes due to the policy notice, a working timeline for New Mexico's restructured BEAD implementation, high-level details of the Benefit of the Bargain round, and time for Q&A.

03/27/2025 - OBAE Closes Application Portal for BEAD; Received 66 Applications in Round One​ 
OBAE has closed the application portal for BEAD after receiving 66 applications from 18 applicants in Round One. Additional information regarding the Scoring and Negotiation Phases will be published in the coming weeks.

​01/03/2025 - OBAE Begins Accepting Applications for BEAD

OBAE has begun accepting applications for the federal Broadband Equity Access and Deployment (BEAD) program. This marks the next step in the distribution of $675 million in federal funding to award state-issued grants for broadband infrastructure across the state. OBAE will accept applications from January 3 to March 24, 2025.

Prequalified applicants can now begin preparing and submitting their formal applications for BEAD funding. Local governments, Tribal communities, nonprofits, internet service providers, cooperatives and other entities that were successfully prequalified are eligible to apply for BEAD funding.

OBAE is additionally publishing an updated list of BEAD-eligible locations that has been deduplicated to account for new enforceable commitments, defaults, and enforceable commitments that lacked Tribal consent. Note that this data is under review by NTIA; a final version will be published once OBAE receives NTIA approval.

​BEAD Prequalification - MANDATORY for Prospective BEAD Applicants
The BEAD Prequalification Window opened September 16 and the final deadline to submit was extended from November 1 to November 15, 2024.
The New Mexico Office of Broadband Access and Expansion (OBAE) is accepting prequalification applications for the BEAD program. The BEAD Prequalification process is mandatory for prospective BEAD applicants. Prequalification enables prospective applicants to establish their qualifications and capabilities to plan, finance, deploy, and maintain broadband networks while driving commercial success and adhering to all legal and regulatory requirements.

Important Timeline Details:
  1. The BEAD Prequalification Submission Window opens September 16!
  2. The Priority Deadline to submit is October 14 at 11:59pm
    Applications submitted by the Priority Deadline will receive an accelerated review process
    and complete applications will receive a decision by November 1.
  3. The Final Deadline to submit was extended from November 1 to November 15, 2024, at 11:59pm. ​​

​Objectives of the Prequalification Phase
The Prequalification Phase evaluates entities intending to apply for BEAD funds and not their projects. Prequalified entities must submit their applications for scoring in the competitive process described in the Scoring Phase. The Scoring Phase will evaluate the merits of their applications based on the framework designated in OBAE’s Initial Proposal, Volume II (IPV2).
​
​​The Prequalification Phase serves several critical purposes:
  1. It filters out potential applicants who do not meet the minimum criteria, ensuring OBAE will only evaluate applications from organizations that meet federal and state requirements and are most likely to achieve the objectives of the BEAD Program. This will enable OBAE to efficiently manage its resources during the limited time available for the Scoring and Negotiation Phases.
  2. It allocates a dedicated period to allow OBAE to evaluate qualifications and address open issues, which in turn allows prospective applicants to later focus on developing strong proposals, knowing that their qualifications have already been reviewed and accepted. Given the rigorous and robust documentation requirements for BEAD, a prequalification process will enable prospective applicants to spread their grant application efforts across a lengthier timeline.
  3. A prequalification process will enable adequate curing opportunity by providing additional time for OBAE to request clarifications and additional information from prospective applicants. With an earlier qualification process, this curing need not take place at the same time as curing the proposed project applications themselves, which will be an enormous undertaking in and of itself.
Prequalification Factors
The BEAD Notice of Funding Opportunity (NOFO) requires the State to ensure that all prospective subgrantees can competently carry out activities funded by the subgrant in compliance with all applicable laws and meet certain cybersecurity and supply-chain risk management best practices. The BEAD NOFO further specifies seven additional types of qualifications Eligible Entities must evaluate in potential subgrantees:

B)  Managerial Capability
C)  Technical Capability
D)  Compliance With Laws
E)  Operational Capability
F)  Ownership
G)  Other Public Funding​
